Centre Name: Brighter Ltd

1. Scope of Agreement and Exam Types

By booking or taking an examination at Brighter Exam Centre, you agree to these Terms and Conditions. Our centre accommodates two distinct types of bookings, which dictate payment and scheduling terms:

  • On-Demand Exams (Booked Directly via the Centre): Exams where registration, scheduling, and payment are handled directly by Brighter Exam Centre.
  • Provider-Booked Exams (Booked via External Exam Bodies): Exams where the candidate registers, pays, and schedules directly through an external examination body (e.g., Pearson VUE, ACCA, etc.) and selects our centre as the testing venue.

Precedence of Provider Terms: All exams delivered at this centre are simultaneously subject to the rules, regulations, and terms of the respective external exam provider. In the event of a conflict regarding exam entry requirements, identification, or candidate misconduct policies, the external exam provider’s terms shall take precedence.

2. Registration, Fees, and Scheduling

2.1 For On-Demand Exams (Direct Bookings)

  • Booking Acceptance & Confirmation: A booking is only considered accepted once it has been processed by our administration team. Upon acceptance, a formal confirmation email will be sent to the candidate (and the employer, if applicable). Bookings are subject to local seat availability.
  • Invoicing & Pre-Payment: All On-Demand CBE bookings will be issued an invoice. This invoice must be paid in full prior to the exam date. Brighter Ltd reserves the right to cancel the booking or refuse entry to the testing room if a balance remains outstanding at the time of the exam.
  • Employer-Funded Bookings: Where an On-Demand exam is booked by a candidate but is to be paid for by their employer, explicit employer consent must be provided to the centre before the booking can be confirmed. The employer will be held liable for the invoice under the standard payment terms.
  • Accuracy of Information: Candidates are solely responsible for ensuring that all registration details perfectly match their official identification.

2.2 For Provider-Booked Exams (External Bookings)

  • External Administration: All scheduling, amendments, receipts, and registration details are managed strictly through your account with the exam provider. Brighter Exam Centre cannot modify, refund, or manually transfer these bookings.

3. Admission, CCTV, and Invigilation Policy

  • Arrival Time: Candidates must arrive at least 30 minutes before the scheduled exam start time. Late arrivals will not be admitted under any circumstances, and fees will be forfeited in accordance with the provider's or centre's policy.
  • Valid Identification: Candidates must present valid, unexpired, government-issued photo identification as specified by their exam provider.
  • Live Invigilation: All exam sessions are strictly overseen by a live, certified Invigilator (Proctor) present in the facility to ensure compliance with exam standards and to assist with technical admissions.
  • CCTV Surveillance: For security, identity verification, and to maintain the integrity of the testing environment, the examination room and waiting areas are subject to continuous CCTV video and audio recording. By entering the testing environment, candidates explicitly consent to being recorded.

4. Candidate Conduct and Test Security

  • Prohibited Items: No personal belongings are permitted in the testing room. This includes, but is not limited to: mobile phones, smartwatches, bags, notes, outerwear, and unapproved calculators. Secure lockers/storage will be provided, but the centre accepts no liability for lost or stolen items.
  • Misconduct and Cheating: Any candidate caught cheating, communicating, using unauthorised aids, or removing exam materials from the room will be immediately disqualified. The Invigilator will terminate the exam session immediately, and a formal incident report (backed by CCTV footage if required) will be submitted to the relevant examining body.

5. Technical Issues and Liability Limitation

  • Technical Interruptions: Computer-based testing relies on local hardware, networks, and external exam provider servers. While Brighter Exam Centre maintains high-standard infrastructure, intermittent technical glitches or internet outages can occur.
  • Resolution: In the event of a technical failure preventing the launch or completion of an exam, the Invigilator will attempt to resolve it live or contact the provider's helpdesk. If it cannot be resolved:
    • For On-Demand Exams, the centre will reschedule you at no extra cost.
    • For Provider-Booked Exams, the centre will issue an official report to the provider.
  • Limitation of Liability: Brighter Exam Centre is not liable for any indirect, consequential, or incidental losses resulting from technical delays or cancellations, including but not limited to travel expenses, lost wages, or missed professional deadlines.

6. Cancellations, Rescheduling, and Refunds

  • For On-Demand Exams: Cancellations or rescheduling requests must be made directly to the centre at least 2 working days prior to the exam date. Cancellations made after this window, or "No Shows," are strictly non-refundable and may be subject to a cancellation fee.
  • For Provider-Booked Exams: All cancellations, cancellation fees, and refund requests are governed entirely by the exam provider's policy and must be processed through their platform. Brighter Exam Centre has no authority to issue refunds or waive provider cancellation fees.

7. Data Protection and Governing Law

  • Data Handling: By testing with us, you consent to the processing of your personal data, exam metadata, and CCTV images. This data is handled in strict compliance with local data protection laws and is shared securely with exam providers for certification and audit purposes.
  • Governing Law: These Terms and Conditions are governed by the laws of the Isle of Man.
